Licenses By-Law


 

 

Sec. 1.             No person shall, within the limits of the Municipality of the County of Cumberland, either as principal or agent, sell by auction, or peddle goods, wares or merchandise of any kind or description whatever within the said Municipality, without having first obtained a license authorizing such person to sell by auction or to peddle.

Sec. 2.             These licenses shall bear the date of the day of the issue thereof, and may either be for six months or one year, and shall be of two classes to be known respectively as:

(a)        Auctioneer's License;

(b)        A Peddler's License;

Sec. 3.             An auctioneer's license shall be personal to the person to whom it is granted and it shall entitle such person only to sell thereunder, and an auctioneer's license shall not entitle the holder to sell goods, wares or merchandise in any other way than by public auction.

Sec. 4.             A Peddler's license shall entitle the person or corporation or any agent of such person or corporation to whom or to which it is issued to peddle goods, wares or merchandise throughout the said Municipality.

Sec. 5.             Every license granted under the provisions of this Chapter shall entitle the licensee to exercise the privilege thereby conferred throughout the entire Municipality, provided always that all rights or privileges conferred by such license shall immediately cease at the end of the period granted thereby and the holder thereof shall not be entitled to any such right or privilege thereafter until he shall have again been licensed and shall have paid the fees in respect of such renewal.


Sec. 6.             This chapter shall not apply to the sale by auction or otherwise or to the barter of the products of the farm, forest or sea or the offering to sell or barter or otherwise trade in said products nor to goods taken and sold under execution and nothing in this by-law shall extend to or include any incorporated town within the limits of the County of Cumberland.

Sec. 7.             Any person who, upon summary conviction, is convicted of selling goods, wares or merchandise of any kind or description by public auction in the Municipality of Cumberland without an auctioneer's license, or any person who is convicted of peddling goods within the said Municipality without a peddler's license, when this chapter requires her or him to have such license, shall be liable to a penalty or not less than $25.00 nor more than $100.00 and in default of payment shall be liable to imprisonment for the period of not less than ten or more than twenty days.

Sec. 8.             No circus or other iterant amusement performance shall be held, offered to view, set up, maintained, carried on or exhibited with the Municipality of the County of Cumberland, without a license first had therefor.

Sec. 9.             Any person violating the provisions of section 8 hereof shall be liable on summary conviction to pay a penalty of not less than one hundred dollars and not more than five hundred dollars and in default to imprisonment for a period of not less than two weeks nor more than two months.

Sec. 10.           Notwithstanding anything in the next two preceding sections no license fee shall be required for any amateur performance or for any exhibitions, concert, show or entertainment for any religious, charitable, temperance or philanthropic object.

Sec. 11.           The license required under section 8 of this By-law is in addition to any license that may be required under the Theatre and Amusements Act.

Sec. 12.           No person, unless he is at the time a rate-payer or resident of the Municipality, shall, for remuneration solicit or take orders for photographs or enlargements of photographs made by any process within the limits of the Municipality without having first obtained a license authorizing such person to solicit or take such orders.


Sec. 13.           In the next preceding section the word "photographer" includes photographers and every agent, representative, canvasser or solicitor of any photographer where such photographer is not a resident or ratepayer of the Municipality.

Sec. 14.           Any person who upon summary conviction for an offense under Section 12 hereof shall be liable to pay a fine of not less than $25.00 nor more than $100.00 and, in default of payment, to imprisonment for a period of not less than ten nor more than twenty days.

Sec. 15.           Forms of license shall be issued by the Clerk of the Municipality upon application therefore and upon payment of the following fees:

Auctioneers License                          - 6 months       - $15.00

- 1 year           - $25.00

Peddler's License                               - 6 months       - $15.00

- 1 year           - $25.00

Circus License                                   - 1 year           - $25.00

Photographers License 1 year          - $25.00
